1. Acceptance of Terms
By creating an account, accessing, or using Solar Marketplace, you agree to these Terms & Conditions, our Privacy Policy, Marketplace Rules, Provider Verification Requirements, and any other policies incorporated into the platform.
If you do not agree, you must not use the platform.
2. About Solar Marketplace
Solar Marketplace is an independent online platform designed to help customers:
- estimate and design preliminary solar systems; - submit solar project requests; - receive and compare quotations; - identify installers and suppliers; - select providers; - track project progress; and - manage information relating to their solar projects.
Solar Marketplace provides the technology that connects customers with independent installers and suppliers.
Solar Marketplace is not itself the installer, supplier, contractor, engineer, manufacturer, financier, or utility provider unless expressly stated otherwise for a particular service.
3. Eligibility and Accounts
Users must provide accurate and current information when creating or maintaining an account.
You are responsible for:
- maintaining the confidentiality of your login credentials; - activity conducted through your account; - promptly updating inaccurate information; and - notifying the platform of suspected unauthorized account access.
Accounts may not be transferred or used to impersonate another person or company.
4. Customers
Customers are responsible for providing accurate project, property, energy-use, and contact information.
System recommendations and quotations may depend on the information supplied by the customer.
Customers must independently review quotations, provider qualifications, warranties, equipment specifications, timelines, and contract terms before accepting a provider.
5. Installers and Suppliers
Providers must submit truthful and accurate company, qualification, licensing, insurance, service-area, product, and contact information.
Providers must:
- maintain any licences, registrations, insurance, certifications, or approvals required for their work; - provide accurate quotations; - clearly disclose applicable pricing, exclusions, warranties, and conditions; - comply with applicable laws and professional standards; and - promptly update information that becomes inaccurate.
Provider verification by Solar Marketplace does not constitute a guarantee of workmanship, performance, financial stability, product quality, or project outcome.
6. Quotations
Quotations are prepared and submitted by independent providers.
Unless expressly identified otherwise, Solar Marketplace does not determine or guarantee:
- quotation prices; - equipment availability; - installation timelines; - warranty coverage; - financing terms; - provider capacity; or - final project cost.
Customers should review each quotation before acceptance.
Once a quotation is accepted, certain records may be retained for transaction history, security, dispute resolution, and audit purposes.
7. Provider Selection and Project Agreements
Selecting an installer or supplier through Solar Marketplace may create a direct commercial relationship between the customer and that provider.
Any installation, supply, service, warranty, payment, or other agreement entered into between them is primarily between those parties.
Solar Marketplace is not responsible for enforcing private agreements between users except where the platform expressly provides a specific enforcement mechanism.
8. Preliminary Solar Designs and Calculations
Solar Marketplace may provide calculators, system-sizing recommendations, equipment recommendations, energy estimates, battery estimates, or other technical guidance.
These results are preliminary estimates only.
They do not replace:
- a site inspection; - structural assessment; - electrical assessment; - utility review; - professional engineering; - manufacturer design requirements; or - approval from relevant authorities.
Actual system requirements may vary because of shading, roof conditions, electrical infrastructure, equipment specifications, user behaviour, weather, utility requirements, and other site-specific factors.
A qualified professional should verify the final system before installation.
9. Contact Between Customers and Providers
After an appropriate provider selection or project stage, the platform may provide approved contact methods between customers and providers.
Users must not misuse contact information obtained through Solar Marketplace for spam, harassment, unrelated marketing, or unauthorized disclosure.
10. Payments
Unless Solar Marketplace expressly introduces an integrated payment service, payments between customers, installers, suppliers, or other providers occur independently of the platform.
Users are responsible for confirming payment terms, invoices, deposits, refunds, and payment security directly with the relevant party.
11. Reviews and Ratings
Customers may be permitted to submit reviews relating to completed projects.
Reviews must:
- reflect genuine experiences; - be truthful; - not contain threats, harassment, discriminatory content, or unlawful material; and - not be manipulated or submitted in exchange for misleading incentives.
Solar Marketplace may remove or restrict reviews that violate platform policies.
12. Prohibited Conduct
Users must not:
- submit false or misleading information; - impersonate another person or company; - manipulate quotations, reviews, ratings, or marketplace activity; - attempt unauthorized access to platform systems; - scrape or extract protected platform data without authorization; - upload malicious code; - interfere with platform security; - use another user's private information improperly; - use the platform for unlawful activity; or - attempt to bypass provider or customer access controls.
13. Intellectual Property
The Solar Marketplace platform, including its software, interface, branding, workflows, design elements, original content, and platform-generated materials, is protected by applicable intellectual property laws.
Users retain ownership of materials they lawfully upload but grant Solar Marketplace the limited rights necessary to store, display, process, and transmit those materials for operation of the platform.
No user may copy, reproduce, reverse engineer, commercially exploit, or create unauthorized derivative versions of the platform except as permitted by law or written authorization.
14. Third-Party Products and Services
The platform may reference third-party manufacturers, products, websites, communication services, payment services, or other providers.
Solar Marketplace does not control and is not responsible for independent third-party services.
15. Platform Availability
Solar Marketplace may periodically experience:
- maintenance; - service interruptions; - technical faults; - software updates; or - third-party service outages.
We may modify, suspend, or discontinue portions of the platform when reasonably necessary.
16. Suspension or Termination
Solar Marketplace may restrict, suspend, or terminate an account where there is reasonable evidence of:
- fraud; - misleading information; - platform abuse; - policy violations; - unauthorized access; - unlawful conduct; or - conduct that creates material risk to other users or the platform.
Where appropriate, users may be asked to provide additional information before access is restored.
17. Disclaimer of Warranties
To the extent permitted by law, Solar Marketplace is provided on an "as available" basis.
We do not guarantee that:
- every provider will be suitable for every project; - every quotation will result in a completed project; - projected solar savings will be achieved; - equipment will perform exactly as estimated; or - the platform will operate without interruption.
Nothing in these Terms excludes rights that cannot legally be excluded.
18. Limitation of Liability
To the maximum extent permitted by applicable law, Solar Marketplace will not be responsible for indirect, incidental, consequential, or special losses arising from independent transactions between customers and providers, including losses resulting from installation work, equipment performance, provider conduct, or private contractual disputes.
This limitation does not apply where liability cannot lawfully be excluded or limited.
19. Privacy
Use of personal information is governed by the Solar Marketplace Privacy Policy.
Users must also handle personal information obtained through the marketplace responsibly and lawfully.
20. Changes to These Terms
Solar Marketplace may update these Terms when necessary to reflect changes in the platform, law, security requirements, or business operations.
Material changes may be communicated through the platform or other appropriate contact methods.
The effective date should be updated whenever a new version is published.
21. Governing Law
Unless otherwise required by applicable law, these Terms are governed by the laws of Jamaica.
Any dispute should first be addressed in good faith between the relevant parties before further legal remedies are pursued.
